Welcome to Beautiful Evolutions Photography ("BEP," "we," "us," or "our"). By accessing or using our website, services, or products, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully. If you do not agree with these terms, you must refrain from using our website and services.

1. Cancellations, Terminations, and Refunds

1.1. Both parties agree that this contract is conditional upon THE CLIENT fulfilling all of his/her obligations in a satisfactory manner, as deemed by BEP. THE PHOTOGRAPHER reserves the right to terminate this Contract and/or remove THE CLIENT from the studio or other location of shooting at any time without a refund if he/she is engaged in behavior including, but not limited to: illegal actions, belligerent, inappropriate, or disruptive behavior as deemed by THE PHOTOGRAPHER. THE PHOTOGRAPHER may terminate this contract at any time if he/she feels that THE CLIENT is not performing in a manner acceptable to the company, or if the terms and responsibilities of this Contract are not being met.

1.2. THE CLIENT agrees that any cancellation must be in writing. No monetary reimbursement will be provided.

1.3. THE CLIENT agrees that in the event that BEP cancels the session for any reason, including but not limited to medical emergency, family emergency, inclement weather, road closures, natural disaster, closure of venue, or similar catastrophe, THE CLIENT will not receive a refund. Instead, the session will be rescheduled for a Boudoir Photography Session to be used within 190 days of the original date.

2. Payment Schedule and Fees

2.1. THE CLIENT agrees that the paid amount is non-refundable to hold the reservation/date with BEP. If THE CLIENT needs to reschedule, there will be a $150 reschedule fee for each reschedule. If THE CLIENT reschedules within 30 days or less of the original appointment, a $200 rescheduling fee will apply. The new appointment must be within 90 days of the original appointment to avoid losing the original booking fee. If THE CLIENT surpasses one reschedule, the initial contract becomes void, and the initial booking fee is credited toward the most current pricing options. All payments made, excluding the original booking and rescheduling fees, are valid as a credit toward any other sessions or products with BEP. This credit expires one year from the original appointment date.

If THE CLIENT cancels, the initial contract becomes void, and THE CLIENT will be subject to the most current pricing options if re-booking later. 2.2. If the retainer or any payments are deemed NSF, THE CLIENT is responsible for a $40 service fee. Photos will not be ordered until the final balance has been paid in full and cleared. Pricing may change without notice and is only guaranteed for products and services selected at the time of contract signing.

2.3. THE CLIENT may not remove items from this Sales Contract once it has been signed. THE CLIENT is responsible for paying for the items selected on the Contract according to the payment due date.

2.4. BEP selects the best photographs for viewing. Files not chosen for viewing are unavailable for purchase or review. Any images not selected during the ordering appointment will be permanently deleted 60 days after the session date. Additional products cannot be added later. Orders cannot be downgraded or canceled. Due to the custom nature of photography, all sales are final, and no refunds or exchanges are permitted. All monies paid are non-refundable.

3. Services

BEP provides photography services, including but not limited to photoshoots, photography bookings, and the option to opt-in for pricing and process information. We also showcase our work on our website.

4. Photography Bookings and Payments

A session fee is required to secure your booking. This fee is non-refundable unless explicitly waived, as outlined in our refund policy.
All requests for waiving session fees must be made in writing and approved by BEP.

5. Refund Policy

Digital Products: Once digital products (e.g., photographs) have been delivered to the client, no refunds will be issued.
Session fees will not be refunded - please see Section 1 & 2 for cancellations and rescheduling.

6. Usage Rights for Photos

All photos displayed on our website have been released by clients, and express permission has been obtained for their use.
Clients who wish to revoke previously granted permissions must contact BEP in writing. BEP will review such requests but is not obligated to remove previously published material.

7. Gathering of Personally-Identifying Information

Certain interactions with BEP require the collection of personally-identifying information, such as when visitors sign up for a blog or submit a contact form. The type and amount of information collected will depend on the nature of the interaction. By providing your information, you consent to its collection, use, and storage as outlined in our Privacy Policy.

8. Security

We prioritize the security of your personal information. However, no method of electronic transmission or storage is entirely secure. While we strive to protect your data, we cannot guarantee its absolute security and accept no liability for breaches beyond our reasonable control.

Our website may contain links to third-party websites that are not operated by BEP. We are not responsible for the content, privacy practices, or terms and conditions of third-party websites. We encourage you to review their policies before interacting with these sites.

10. Cookies

These Terms and Conditions are governed by and construed in accordance with the laws of the United States. By using our services, you consent to the exclusive jurisdiction of the courts in the United States to resolve any disputes.

13. Changes to Terms and Conditions

BEP reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your continued use of our website and services following any changes indicates your acceptance of the new terms.
